tight elastic waistband but good fabric

I own the top that goes with these and I liked it so much I decided to get the bottoms. To my disappointment, the firm elastic waistband was strangling me even though the rest of the pants fit. This is my only problem with these, but I have to send it back. I wear a 6 and I ordered a medium. I have a small waist for my size and usually I have the opposite problem with bottoms. I do love the top though, nice and sheer to go under my everyday clothes, but it is strictly an undergarment since it is completely see-through like pantyhose. Incidentally, there is something strange with the labelling. This is advertized as Terramar. My top and bottom (ordered 3 months apart so not just a freak mistake) both say "Sport Silk" on the tags and nowhere say Terramar, and they came in a blank package. BUT I ordered men's bottoms for my husband and they DO say Terramar on the tag and package insert. So I'm not sure what I have here. Love the top though. Only order bottoms if you do not mind the tight elastic band coming high up on the waist.
