When did a "38 waist" stop being 38-inches

In all, I ordered 5 pairs of these "cotton twill pants"--38x32....first shipment of 2 pair fit perfectly...so I ordered 3 more pair...of those 3, only one fit...it was, in fact, a 38-inch waist....but of the other 2 pairs, one was a 37-inch waist, and the other was a 36.5-inch waist...so I now have to go to the hassle of returning 2 pairs...and being dinged $6.95 for return shipping--which wouldn't be necessary if "38" actually meant "38". The 3 pair that fit were originally made for IZOD...the 2 that didn't were made for other outlets......the 3 pair that fit are fabulous pants--but the 2 pair that didn't fit came from the same "item" on-line... but were very different pants---WHICH DIDN'T FIT !!!!!!!!!
