The first problem I fixed by ripping out the seam that holds the elastic down to the waist, and got rid of the drawstring. it looks funky, but who is going to see them? The legs I can shorten one of these days. Got a large and they're plenty roomy. 5'3" and 140#.

I have this trouble with the Hatley brand. Super cute stuff, soft and warm, but the sizes are hit and miss. Some just right, some too tight. I probably won't be able to wear them sadly.

These are a natural waist which means that it lays right below to right at the belly button. If you do not tie the drawstring they may fall down lower.
The large fits to my natural waist, I definitely wouldn't call these low rise.
